COMPLIANCE REQUIREMENT

·        Purchase New Compliance Posters (Federal and State).

·        State Laws: Review State Laws for effective dates and changes to employment protections and minimum wage.

·        IRS: Employees need to fill out the 2020 W-4 form. Contractors fill out a W-9 form.

·        FLSA: New overtime law.  Ensure your employees are designated correctly.

·        I-9: The Immigration Reform & Control Act (IRCA) requires all employers to hire those who can legally work in the United States.  Audit I-9 forms and ensure they are up-to-date.

·        EEOC: Review your handbook including pregnancy, harassment, etc. policies. Check your state updates.

·        OFCCP: New 2020 form. Contractors are required to use until there is a new one adopted. Must complete the disability self-ID every 5 years.

·       ACA Health Care: Employers provide notices to new employees if they offer health care benefits.  If employers do not provide health care benefits then provide notice.

·        VEVRAA: The Vietnam Era Veterans Readjustment Assistance Act requires contractors to take affirmative action to employ veterans covered under the act.  Section 503 of the Rehabilitation Act required the same for people with disabilities. Self-identity forms are required.

·        EEOC: Review employment application for state requirements “ban the box” laws.

·        ERISA: The Employee Retirement Income Security Act (ERISA) regulations employers who offer pension or benefits plans for their employees. Review federal new laws on pension and welfare benefits plans.

·        OSHA: Review industry federal, state and local safety regulation update.

·        LMRDA: Review Labor-Management Reporting and Disclosure Action for union environments on employee new protections.

·        USERRA: The Union Services Employment and Reemployment Rights Act protects those who have served in armed forces and have a right to reemployment with the employer when they entered service.  Review those employees who have this status in your company.

·        DOL: Review the garnishment of employees.  This is regulated under the Consumer Credit Protection Act (CCPA).

·        DOL: WARN (The Workers Adjustment and Retraining Notification Act) should be reviewed in companies 100 or more. The law protects employees to provide 60 day calendar day advance notification of plant closings or mass layoffs.

·        DOL: Review the Family and Medical Leave Act (FMLA over 50 employees). Audit paperwork for proper documentation and HIPPA protection.

·        HHS/DOL: Health and Human Service audit The Health Insurance Portability and Accountability Act (HIPAA) protects employee health information for FMLA, ADA and Workers Compensation.

·       IRS: W-2 distribution deadline. Include the cost of employer-paid health plans on W-2 forms. Form 1099-R for contractors.

·       IRS: 1095-C schedules to all ACA full-time employees (50+ employees)

·       EEOC: Component 2 Pay Data portal has been extended until 1/31/2020 to report the 2017 and 2018 pay data.

OSHA: Employers (11 employees and more) are required to post the Log of Work-Related Injuries and Illnesses (Form 300A) in their workplaces from Feb. 1 until April 30 of each year.

IRS: Deadline for 1094-C/1095-C schedules for 2019 paper filing.  This applies to employers with total employee counts (less than 250) who elect paper file their ACA filings with the IRS.

  • EEO-1 Report: By this date, employers with federal government contracts of $50,000 or more and 50 or more employees and employers that do not have a federal government contract but have 100 or more employees must file an EEO-1 report with the EEOC.
  • VETS-100A Report: By this date, federal contractors must file the VETS-100A Report for government contracts of $100,000 or more that were entered into or modified on or after Dec. 1, 2003, as well as the VETS-100 Report for any unmodified government contracts of $25,000 or more that were entered into prior to Dec. 1, 2003.
